The Zahlungsbefehl
Upload a photo or a scan and the fields fill themselves. Or type the details in by hand - they are all on the first page.
Several pages at once are fine: a photo or scan of each page, PDF, JPG or PNG.
Confirm the details
Please compare every field with your document - above all the case number and the amounts. We copy them exactly as they are printed there; correct anything that differs. What stands here is what will appear, word for word, in your letter.
Automatic text recognition was not available. Please enter the details by hand.
Almost nothing could be read from the scan, so no fields were filled in. You can type the details below in by hand (they are all on the first page), or go back and upload a brighter photo taken straight from above.
You are typing the details in by hand. They are all on the first page of the Zahlungsbefehl (conditional order for payment).
How did the Zahlungsbefehl (conditional order for payment) reach you?
The deadline runs from the day the document counts as served - and in this country that depends on how it was delivered, not only on when. Answer both questions from the delivery slip, the notice or the envelope.
How was it delivered?
A deposited item counts as served on the first day of the collection period printed on the notice (Sec. 17 (3) ZustG). If you were away and could not learn of it in time, service only takes effect the day after your return - tell the court so in that case.
Your deadline
The period is four weeks from service (Sec. 248 (2) ZPO) and cannot be extended. If you post the letter by the last day at the latest, the days in the post do not count (Sec. 89 GOG) - keep the receipt. Do not rely on the last day: send it several days early.
This calculation is a helper, not legal advice. Catius Documents does not review your individual case. If you are unsure, or the claim is large, we recommend getting legal advice.
Your details
You can object to the whole claim or expressly to part of it. No grounds are required before the Bezirksgericht - a filed Einspruch sets the order aside and the case goes on as an ordinary lawsuit.
What is your Einspruch directed against?
Decide for each item whether you contest it. The Einspruch is expressly limited to the items you contest (Sec. 249 (1) ZPO) and lists them one by one; everything else is accepted.
Note: for the part you do not contest, the Zahlungsbefehl stays in force and becomes enforceable.

This is what goes into your document. Check the case number and the amounts above all.
Your document is ready. You get it immediately after payment - with your details and without a watermark.
