The platební rozkaz
Upload a photo or a scan and the fields fill themselves. Or type the details in by hand - they are all on the first page.
Several pages at once are fine: a photo or scan of each page, PDF, JPG or PNG.
Confirm the details
Please compare every field with your document - above all the case number and the amounts. We copy them exactly as they are printed there; correct anything that differs. What stands here is what will appear, word for word, in your letter.
Automatic text recognition was not available. Please enter the details by hand.
Almost nothing could be read from the scan, so no fields were filled in. You can type the details below in by hand (they are all on the first page), or go back and upload a brighter photo taken straight from above.
You are typing the details in by hand. They are all on the first page of the platební rozkaz (order for payment).
Some orders say you must file a written statement on the merits within a period after the odpor period (Sec. 114b o. s. ř.). If yours does, copy the number of days here; if not, leave it empty. We never assume it.
The letter is prepared for a case with one claimant and one defendant. If there are more parties, print one copy for the court and one for each other party, and check that the wording fits your case.
How did the platební rozkaz (order for payment) reach you?
The deadline runs from the day the document counts as served - and in this country that depends on how it was delivered, not only on when. Answer both questions from the delivery slip, the notice or the envelope.
How was it delivered?
Delivered into a data box and not opened within 10 days, the order counts as served on the tenth day (Sec. 17 (4) of Act No. 300/2008 Sb.); if you logged in earlier, on that day. An order for payment cannot be left in your letterbox - it must be handed to you personally or delivered into your data box (Sec. 173 (1) o. s. ř.).
If you logged in within 10 days, that day is the day of service. Otherwise the tenth day counts.
Your deadline
Your order tells you to file a written statement on the merits within this period after the odpor period. If you do not, and do not tell the court a serious reason, the court will treat the claim as admitted (Sec. 153a (3) o. s. ř.). We do not prepare that statement - put the date in your calendar and get legal advice for it.
The period is 15 days from the day of service (Sec. 172 (1) o. s. ř.). The day of service does not count; a last day falling on a Saturday, Sunday or public holiday moves to the next working day (Sec. 57 o. s. ř.). Handing the letter to the post office on the last day is enough (Sec. 57 (3)) - keep the receipt, and send it several days early anyway.
This calculation is a helper, not legal advice. Catius Documents does not review your individual case. If you are unsure, or the claim is large, we recommend getting legal advice.
Your details
The odpor always covers the whole order: once filed in time, the platební rozkaz is set aside in full (Sec. 174 (2) o. s. ř.) and the court schedules an ordinary hearing. No grounds are required (Sec. 174 (3)).
Scope of the odpor
Against the whole order (the only form the law knows)
