The fizetési meghagyás
Upload a photo or a scan and the fields fill themselves. Or type the details in by hand - they are all on the first page.
Several pages at once are fine: a photo or scan of each page, PDF, JPG or PNG.
Confirm the details
Please compare every field with your document - above all the case number and the amounts. We copy them exactly as they are printed there; correct anything that differs. What stands here is what will appear, word for word, in your letter.
Automatic text recognition was not available. Please enter the details by hand.
Almost nothing could be read from the scan, so no fields were filled in. You can type the details below in by hand (they are all on the first page), or go back and upload a brighter photo taken straight from above.
You are typing the details in by hand. They are all on the first page of the fizetési meghagyás (order for payment).
This paper letter is meant for a private individual acting alone. Companies, other persons obliged to file electronically and representatives file through the notaries' electronic system - if that applies to you, the notary may not accept a paper filing.
How did the fizetési meghagyás (order for payment) reach you?
The deadline runs from the day the document counts as served - and in this country that depends on how it was delivered, not only on when. Answer both questions from the delivery slip, the notice or the envelope.
How was it delivered?
A refused item counts as served on the day of the attempt. An item returned 'nem kereste' counts as served on the fifth working day after the second delivery attempt (Pp. 137. § (2)) - the notary can tell you that date from the case number.
Your deadline
The period is 15 days from service (Fmhtv. 28. § (1)). The day of service does not count; a last day falling on a non-working day moves to the next working day (Pp. 146. §). The court recess - 15 July to 20 August and 24 December to 1 January - is not counted (Pp. 148. §). Posting by registered mail on the last day at the latest keeps the deadline; ordinary post does not. Send it several days early anyway.
This calculation is a helper, not legal advice. Catius Documents does not review your individual case. If you are unsure, or the claim is large, we recommend getting legal advice.
Your details
You can contest the whole claim or part of it. No grounds are required. A filed ellentmondás turns the matter into an ordinary lawsuit (Fmhtv. 37. §).
What is your ellentmondás directed against?
Decide for each item whether you contest it. The letter lists the contested items one by one and then names what you do not contest.
Note: the part you do not contest becomes final and enforceable (Fmhtv. 28. § (2)). If in doubt, contest the whole claim.
Two witnesses
A typed letter needs two witnesses' names, addresses and signatures to have full probative force (Pp. 325. § (1) b)). You can type their names and addresses here now, or leave the lines blank and fill them in by hand before they sign.
